“We”, “us” and “our” mean this seller. “You” means the purchaser or, for the provisions relevant to viewing and acceptable use, the person using the website.
Your contract for the gift is with us. Payment is taken through Stripe Checkout, where Sold through Link, LLC, a Stripe affiliate, acts as merchant of record: it processes the payment, appears on your statement as “LINK.COM* LOVELY.GIFT” or similar, sends the payment receipt and any invoice, collects indirect tax such as VAT and offers payment support under the Link terms. We remain responsible for the gift, its delivery and conformity, complaints about it and your statutory consumer rights.
Terms version: 1.0. Effective date: 4 October 2026.
2. What you are buying
A gift is digital content: the selected visual gift, personalised with the names and message you enter, accessible through a web link. The purchase includes hosting that gift for 30 days from payment confirmation. There is no subscription or automatic renewal.
No physical flowers, objects or parcels are delivered. The purchase does not include ownership of the underlying artwork, model files or software, a financial asset, or a cash-redeemable gift card. The recipient does not need to pay to open the gift.
The product description and preview form part of the purchase information. Colours and rendering may vary with displays and supported device capabilities, but this does not excuse a gift materially differing from its description or agreed features. We identify any material limitations before payment.
3. Eligibility and technical requirements
You must be at least 18 and legally able to make the purchase. Use a payment method you are authorised to use. We may limit purchases where required by applicable sanctions, payment restrictions or other law; available checkout countries indicate where we currently accept orders.
Viewing requires an internet connection and a supported browser with JavaScript. Interactive 3D effects require compatible graphics capabilities, including WebGL. Where 3D rendering is unavailable, a still-image fallback is provided with reduced interaction. The gift is designed for current versions of Chrome, Edge, Firefox and Safari on computers and mobile devices with JavaScript and WebGL (hardware acceleration) enabled; in other environments only the still-image fallback may be shown. Internet and device costs are yours. If an advertised feature does not work in the stated supported environment, the statutory remedies below remain available.
4. Ordering and contract formation
Choose a gift, enter the displayed names and message, and review the preview, price and access period. You can correct your entries before placing the order. You accept these Terms with the checkbox shown before the payment step, and we record that acceptance with your order; you then proceed through Stripe Checkout. The final payment button clearly states the obligation to pay.
Your order becomes a binding contract when payment is successfully confirmed and we confirm acceptance of the order. We provide a confirmation to the email address supplied at checkout, in a form you can retain: the order details, the amount paid and any tax, the 30-day access period, the gift link and a copy of these Terms as accepted. If payment succeeds but confirmation or the gift link is missing, contact us; do not assume that you need to pay again.
The contract language is the supported language selected for your order (English, Polish or German), subject to mandatory language requirements. You may save these Terms before purchasing and retain the order confirmation. We retain records as described in the Privacy Policy; there is no customer account or online contract archive for you to log into.
5. Price and payment
The price of one gift depends on the country you order from, as determined from your internet connection: PLN 14.99 including tax in Poland, €3.49 including tax in countries that use the euro, and US$3 plus applicable tax shown at checkout elsewhere. The price that applies to you is shown on the site before you order and again on the payment page. There is no shipping charge, recurring charge or recipient fee. The total is shown before the payment is authorised. A different future price applies only to a future order for which it is clearly disclosed.
Stripe processes payment using the payment methods shown at checkout. Your bank or payment provider may separately charge currency-conversion or other fees, which it determines. Payment is charged in the currency of the price shown when you order unless checkout expressly offers a different transaction currency that you choose.
Link sends the payment receipt and any invoice required by law and, as merchant of record, calculates, collects and remits indirect tax such as VAT on the transaction. For billing questions, contact contact@lovely.gift with the order reference; Link also offers payment support at support.link.com. We remain responsible for refunds required by law. Link may also refund a payment under its own refund policy if you ask within 60 days of purchase; where Link's refund policy is more favourable to you, it applies.
6. Delivery, sharing and duration
After successful payment verification, we make the gift link available through the purchase flow, normally immediately and no later than 24 hours after payment confirmation. The link gives access to the purchased gift; the recipient does not have to open it for it to have been supplied to you.
We email the gift link to the purchaser and recipient email address entered by the purchaser. The purchaser can also copy the link or download its QR code. Check the recipient's email address carefully. We do not send text messages. Contact contact@lovely.gift if you lose the link, and provide information sufficient to verify the purchase.
Anyone with the gift URL can view the names and message. There is no recipient authentication. Avoid posting it publicly unless you intend that disclosure. We do not guarantee that recipients will keep a link or its contents confidential.
Hosting is included for 30 days from payment confirmation. The access period is shown before purchase and in your confirmation. We do not promise permanent or lifetime hosting. At the end of the stated period, access may end and content may be deleted under the Privacy Policy. Ending or interrupting access before the promised period does not remove your statutory remedies.
If you need a gift corrected or removed, contact contact@lovely.gift. We assess verified requests, privacy rights and effects on other people. A purchaser's voluntary removal request is not automatically a cancellation or refund request, and we will clarify the effect where necessary.
7. Cancellation and the right of withdrawal
Where EU/EEA consumer withdrawal rules apply, you normally have 14 days from conclusion of the contract to withdraw without giving a reason. Similar or additional mandatory rights under applicable local law remain available.
For digital content supplied without a tangible medium, the right may end early only where all legal conditions are met, including your express prior consent to supply during the withdrawal period and your acknowledgement of the resulting loss of that right. We do not ask for that consent, so immediate supply does not end your right of withdrawal early; it remains available for the statutory period. Personalisation alone is not our basis for excluding withdrawal.
An ongoing digital-service element, where legally classified as such, is subject to the rules applicable to services; an immediate-supply checkbox for digital content does not automatically extinguish rights for an unfinished service. Any permitted proportional payment requires the statutory conditions to be met. Your rights in defective or undelivered content are unaffected by consent to immediate supply.
To exercise an available right, send a clear statement to contact@lovely.gift or Harcerska 40, 98-300 Gaszyn, or use our online withdrawal form at lovely.gift/withdraw (“Withdraw from contract here”), which emails you an acknowledgement with the date and time we received it. You may use the model notice below, but it is not compulsory. Sending the notice before the deadline is enough. Where applicable law extends the period because required information was missing, that extended period applies.
For a valid withdrawal, we reimburse amounts required by law without undue delay and within 14 days of receiving the notice, using the original payment method unless you expressly agree otherwise and incur no fee. There is no physical item to return. Access to the withdrawn gift may be disabled.
8. Missing, faulty or misdescribed gifts
You are entitled to digital content and services that conform to the contract and applicable law. We provide necessary conformity and security updates for the legally required period and inform you where installation or action is needed. The advertised hosting period does not shorten statutory rights or claim periods.
If a gift is not supplied, ask us to supply it. If we fail without undue delay or within an additional agreed period, you may end the contract as the law permits. Immediate termination may be available where we refuse delivery or timely supply was essential under the applicable rules.
For non-conformity, you can request that we bring the gift into conformity without charge, within a reasonable time and without significant inconvenience. If this is impossible or disproportionate, fails, is refused, or the problem otherwise meets the legal conditions, you may obtain a proportionate price reduction or terminate the contract. For paid digital content, termination for non-conformity may be unavailable for a merely minor defect; applicable burden-of-proof rules remain unchanged. Refunds due under these remedies are made within the applicable statutory deadline, including 14 days where Polish digital-content rules require it.
We do not exclude complaints because they concern appearance if the gift fails to match the agreed description or preview. A change of personal preference by itself is different from a defect, but any available withdrawal right still applies.
On withdrawal or termination, we handle your personal data under data-protection law. Where required, we also make eligible content that you provided available to you free of charge within a reasonable time in a commonly used machine-readable format, subject to statutory exceptions. You should stop using the terminated gift and should not continue distributing access to it.
9. Complaints and support
Send complaints to contact@lovely.gift or Harcerska 40, 98-300 Gaszyn. Describe the issue and requested solution and, if available, include an order reference. A particular form, original receipt or screenshot is not a mandatory condition for exercising legal rights. Questions about the payment itself, such as charges, receipts or payment refunds, may also be raised with Link at support.link.com; complaints about the gift are handled by us.
We respond to consumer complaints within 14 days of receipt, on paper or another durable medium, unless a different applicable rule requires otherwise. The statutory consequences of failing to respond in time remain applicable. Requests to clarify a complaint do not automatically restart the legal deadline.
These consumer protections also apply to natural-person entrepreneurs to the extent Polish law extends them to purchases connected with their business but not professional in nature.
10. Your message and permitted use
Only submit content you are entitled to share. Do not use the service for threats, harassment, stalking, fraud, unlawful discrimination, infringement of intellectual property or privacy, sexual exploitation, or other illegal content. Do not include payment credentials, identity documents or another person's sensitive personal information. Do not attempt to access other gifts without authorisation, bypass payment, disrupt the service or exploit vulnerabilities.
You retain your rights in your original message. You grant us a limited, non-exclusive permission to store, reproduce and display it only as needed to deliver the gift, maintain the service, handle support and comply with law. This does not permit us to use your message in advertising. Any retained copies remain subject to the Privacy Policy and applicable law.
We may restrict or remove content where reasonably necessary to address unlawful content, a substantiated rights complaint, a security incident or a serious breach. Where lawful and practicable, we explain the reason and let the affected purchaser contact support for review. Urgent restrictions may occur first where necessary to prevent harm. Removal is not an automatic forfeiture of every refund or consumer right.
11. Our artwork and software
We and our licensors retain rights in the website, artwork, 3D assets, branding and software. Your purchase gives you and people with whom you share the gift a non-exclusive right to access and enjoy it for personal use during the included access period. It does not authorise extraction or resale of the underlying assets. Statutory exceptions and uses permitted by law remain unaffected.
12. Availability, changes and responsibility
We take reasonable care to deliver the promised service. Temporary maintenance or technical faults may occur, but do not remove your rights if the service fails to conform to the contract. We are responsible under applicable law; we do not impose a blanket “as is” exclusion or cap statutory liability at the price paid.
Necessary security or conformity updates may be made without extra charge. These Terms do not grant us a general right to materially change a purchased gift, reduce its agreed access period or replace its essential features. Where applicable law permits or requires other changes to a continuing service, we provide the required information and preserve any associated termination and refund rights.
An updated version of these Terms applies to orders placed after its stated effective date. Existing purchases remain subject to the version agreed when ordered, except for changes validly agreed with you or required by law.
13. Governing law and disputes
Polish law governs these Terms. If you are a consumer, this choice does not deprive you of protections that cannot be waived under the law applicable to you, including relevant law of your country of habitual residence. Nothing here excludes mandatory consumer guarantees, privacy rights or access to competent courts. There is no compulsory arbitration clause, class-action waiver or exclusive requirement for consumers to sue in Poland.
You may seek assistance from a local consumer advice body. Polish consumers can contact a municipal or district consumer ombudsman or the appropriate Trade Inspection authority. Information about EU alternative dispute-resolution bodies is available at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies. Cross-border EU consumer assistance is also available through the European Consumer Centres Network.
We decide on voluntary participation in out-of-court dispute resolution (ADR) case by case. Where a complaint remains unresolved, we tell you on paper or another durable medium whether we agree to take part in such a procedure and which ADR body is competent; under Polish law, if we make no such statement, we are deemed to agree. These routes do not prevent you from going to court.
